By paying for Franklin Golf Lab services, accessing Franklin Golf Lab website, and/or creating an account through Franklin Golf Lab website, the Member hereby agrees to the terms and conditions listed herein. Franklin Golf Lab, LLC is a Tennessee limited liability company ("Franklin Golf Lab"), which owns and operates an indoor golf simulator in Franklin, Tennessee.

You agree to be bound by the general terms of service with Franklin Golf Lab under this Agreement as it pertains to website use, protection of Franklin Golf Lab's intellectual property, storage of data, and user restrictions. Upon your use and/or payment of any money to Franklin Golf Lab, you expressly agree to the terms of the Membership Agreement (a separate agreement) and the Waiver (a separate agreement).

Intellectual Property

Franklin Golf Lab and other marks and logos are the intellectual property of Company and its subsidiaries. Our Site and all of its contents (including, without limitation, articles, text, photographs, images, illustrations, graphics, video material, audio material, and software (collectively, the "Intellectual Property"), are protected by copyright, trademark and other laws of the United States, as well as international conventions and the laws of other countries.

No portion of this Site may be reproduced, duplicated, copied, sold, or otherwise exploited for any commercial purpose that is not expressly permitted by Franklin Golf Lab.

You may browse through the Site and occasionally download small amounts of materials appearing on the Site that are of personal interest to you for your personal, non-commercial use. You must keep intact all copyright, trademark and other notices contained in your personal copies.

Proper Use of Our Site

This Site is made available to provide information about Franklin Golf Lab. You may not use this Site for any purpose that is unlawful or prohibited by this Terms and Conditions Agreement, or cause damage on or through this Site.

You agree that none of your communications with or through the Site will violate any applicable local, state, national, international or other law. You further agree that none of your communications with or through the Site will infringe upon the rights of any third party or contain defamatory, libelous, abusive or obscene material.

UNDER NO CIRCUMSTANCES WILL FRANKLIN GOLF LAB, ITS AFFILIATES, LICENSORS, SUPPLIERS OR ANY OTHERS INVOLVED IN CREATING THE SITE AND/OR ITS CONTENTS BE LIABLE FOR ANY DAMAGES OR INJURY, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES RESULTING FROM ANY CIRCUMSTANCE INVOLVING THE SITE, ITS FEATURES AND/OR ITS CONTENT.

Limitation of Liability

Applicable law may not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. However, in no event shall the aggregate liability of Franklin Golf Lab or any affiliate, licensor, supplier or any other party involved in creating this Site and/or its contents, to you or any third party for damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this Site or $100, whichever is less. You agree to bring any and all actions within one year from the date the cause of action first occurred and that actions brought after this date will be forever barred.

E-mail submissions over the Internet may not be secure. Please consider this fact before e-mailing any personal or confidential information.

Feedback and Submissions

Submission of any remarks, suggestions, material, information, ideas or other communications (each a "submission") to this Site will be deemed to transfer to Franklin Golf Lab all present and future ownership and intellectual property rights in such submission of every kind and nature everywhere.

Franklin Golf Lab is not responsible for any submission on its social media pages, including but not limited to Facebook and X, which may feed into the Site. You shall not submit or otherwise publish through such social media pages any content which libels, defames or invades privacy, or is obscene, pornographic, abusive, or threatening.

Additional Terms

Franklin Golf Lab may terminate your access to this Site immediately without notice if, in Franklin Golf Lab's sole discretion, you fail to comply with any of the terms of this Terms and Conditions Agreement.

Franklin Golf Lab reserves the right to seek all remedies available at law and in equity for violations of this Terms and Conditions Agreement, including suspending or blocking your access to the Site.

Children's Information

With respect to children's privacy, we do not knowingly collect any personally identifiable information from children under the age of thirteen years. This Site is directed to adults at least 13 years old, and when a user discloses personal information on this Site, the user is representing to us that he or she is 13 years or older.

No Waiver

No delay or failure by Franklin Golf Lab to enforce any of these Terms and Conditions Agreement shall constitute a waiver of any of our rights under this Terms and Conditions Agreement. Only a specific, written waiver signed by an authorized representative of Franklin Golf Lab shall have any legal effect.

Severability

If any clause or provision set forth in this Terms and Conditions Agreement is determined to be illegal, invalid or unenforceable under present or future law, the clause or provision shall be deemed to be deleted without affecting the enforceability of all remaining clauses or provisions.

Governing Law and Jurisdiction

This Franklin Golf Lab Site is operated by Franklin Golf Lab, a Tennessee LLC. This Terms and Conditions Agreement and any disputes arising under or related to this Terms and Conditions Agreement, the Membership Agreement, the Waiver and/or any additional terms to this Site shall be governed by the laws of the State of Tennessee without reference to its conflict of law principles.

You agree to submit to the exclusive personal jurisdiction and venue of the courts located within Williamson County, Tennessee for any legal proceeding arising from this Terms and Conditions Agreement, regardless of the cause of action or which party has initiated the legal proceeding.
